Lawmaker proposes 15 days extra leave credits for OFW spouses

To help ease the demands placed on the shoulders of spouses of overseas Filipino workers (OFWs), a Philippine lawmaker filed a bill aiming to give 15 days of extra leave credits with pay every year to legitimate OFW spouses working in the private and public sectors.

In a news release on Thursday, Rep. Ma. Theresa Bonoan-David (4th District, Manila) said she filed House Bill 6196 or the "Special Leave for Overseas Workers’ Spouses Act" because OFW spouses play the role of "both father and mother back home and like a single parent, they attend to the needs of their families single-handedly."

If the bill is ratified, employees who will avail of the leave privilege have to submit the following to their employer:
- Marriage contract (copy)
- Passport of OFW (copy)
- Nature and place of work of OFW concerned

Meanwhile, those not covered by the bill are employees who are:
- sick
- on vacation
- on forced or study leave
- have absences without official leave
- have availed of other forms of leaves, and
- whose services prevent loss of life and damage to property.

The private employers who will grant the leave benefit will be given an income tax deduction from their gross income each taxable year, based on the actual cost paid by the employer.

"Private establishments are required to keep separate records of their employees who have availed of this leave benefit for purposes of claiming tax credits," Bonoan-David explained.

Any entity that violates the proposed bill may face a fine up to P50,000 or jail time of 30 days to 6 months.

If the bill is approved, the Secretary of Labor and Employment and the Chairman of the Civil Service Commission will issue rules and regulations necessary for the implementation of the law.
